Patient outcome after serious brain injury is highly variable. Following a period of coma, some patients recover while others progress into a vegetative state (unresponsive wakefulness syndrome) or minimally conscious state. In both cases, assessment is difficult and misdiagnosis may be as high as 43%. Recent advances in neuroimaging suggest a solution. Both functional magnetic resonance imaging and electroencephalography have been used to detect residual cognitive function in vegetative and minimally conscious patients. Neuroimaging may improve diagnosis and prognostication. These techniques (...) are beginning to be applied to comatose patients soon after injury. Evidence of preserved cognitive function may predict recovery, and this information would help families and health providers. Complex ethical issues arise due to the vulnerability of patients and families, difficulties interpreting negative results, restriction of communication to “yes” or “no” answers, and cost. We seek to investigate ethical issues in the use of neuroimaging in behaviorally nonresponsive patients who have suffered serious brain injury. The objectives of this research are to: (1) create an approach to capacity assessment using neuroimaging; (2) develop an ethics of welfare framework to guide considerations of quality of life; (3) explore the impact of neuroimaging on families; and, (4) analyze the ethics of the use of neuroimaging in comatose patients. We present a probabilistic extension to active path analyses of token causation. The extension uses the generalized notion of intervention presented in : we allow an intervention to set any probability distribution over the intervention variables, not just a single value. The resulting account can handle a wide range of examples. We do not claim the account is complete --- only that it fills an obvious gap in previous active-path approaches. It still succumbs to recent counterexamples by Hiddleston, because it (...) does not explicitly consider causal processes. We claim three benefits: a detailed comparison of three active-path approaches, a probabilistic extension for each, and an algorithmic formulation. (shrink)

South Africa is a major hub of HIV prevention trials, with plans for a licensure trial to start in 2015. The appropriate standards of care and of prevention in HIV vaccine trials are complex and debated issues and ethical guidelines offer some direction. However, there has been limited empirical exploration of South African stakeholders’ perspectives on ethical guidance related to prevention and care in HIV vaccine trials.

There is little published literature on the ethical concerns of stakeholders in HIV vaccine trials. This study explored the ethical challenges identified by various stakeholders, through an open-ended, in-depth approach. While the few previous studies have been largely quantitative, respondents in this study had the opportunity to spontaneously identify the issues that they perceived to be of priority concern in the South African context. Stakeholders spontaneously identified the following as ethical priorities: informed consent, social harms, collaborative relationships between research stakeholders, (...) the participation of children and adolescents, access to treatment for participants who become infected with HIV, physical harms, fair participant and community selection, confidentiality, benefits, and payment. While there is some speculation that research in developing countries poses special ethical challenges, overall no issues were identified that have not been anticipated in international guidance, literature and popular frameworks. However, the South African context affords a distinctive gloss to these expected issues; for example, respondents were concerned that the predominant selection of black participants may perpetuate racist practices of apartheid. Stakeholders should be aware of contextual factors impacting on the implementation of ethical principles. We make a series of recommendations for South African trials, including amendments to the ethical-legal framework and research policies, and, for further research. (shrink)

Functional MRI shows promise as a candidate prognostication method in acutely comatose patients following severe brain injury. However, further research is needed before this technique becomes appropriate for clinical practice. Drawing on a clinical case, we investigate the process of obtaining informed consent for this kind of research and identify four ethical issues. After describing each issue, we propose potential solutions which would make a patient’s participation in research compatible with her rights and interests. First, we defend the need for (...) traditional proxy consent against two alternative approaches. Second, we examine the impact of the intensive care unit environment on the informed consent process. Third, we discuss the therapeutic misconception and its potential influence on informed consent. Finally, we deal with issues of timing in recruiting participants and related factors which may affect the risks of participation. (shrink)

This paper presents an attempt to integrate theories of causal processes—of the kind developed by Wesley Salmon and Phil Dowe—into a theory of causal models using Bayesian networks. We suggest that arcs in causal models must correspond to possible causal processes. Moreover, we suggest that when processes are rendered physically impossible by what occurs on distinct paths, the original model must be restricted by removing the relevant arc. Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. This principle states that a person is psychologically healthy and well only if she or he acts in critical situations on preferences and desires that are responsibly in her or him rather than being (...) merely in her or him. Various analyses have been proposed of what it means for a desire or preference to be responsibly in a person—namely, that he or she identify with it or that the desire or preference be part of his or her wholehearted or decisive identity as a person. Harry Frankfurt (1988) has formulated a version of the principle in his accounts of personal caring and freedom of will. Charles Taylor (1976) has deployed a version of the principle in his account of self-assessment and personal redefinition. In this issue of Philosophy, Psychiatry, & Psychology, Mark Rego with deference to Frankfurt suggests how a responsible innerness principle (Rego does not name the principle as such, of course, because the neologism is my own) might be deployed in a therapeutic setting. In this brief commentary I explore an obvious commitment of the principle, namely that there is a difference between the responsible psychological inside of a person and both the mere (nonresponsible) inside and the outside. In connection with the presupposition I include some comments on Rego's thoughtful and suggestive paper.Individuating MeWhat individuates a person? What makes a person one person or individual as opposed to another person or individual?One hypothesis is that an individual person is individuated by their being a particular living human animal (see Olson 2003; Van Inwagen 1990). Mark Rego (the name) refers to one particular living human animal. George Graham (the name) refers to another. In my case an animalist (someone who holds that an individual human person is a particular living human animal) would say that I am nothing other than the six-foot tall living human animal whose photograph you would take if you were to take a picture of me writing this brief commentary. I am not an immaterial substance nor am I a composite made out of any such substance and this animal body (or some part of it). I am, instead, a biological being, made of biological parts—the organs, cells, and so forth of which living human animals are made.Although one might worry about just how animals themselves are individuated, it is not too hard to appreciate what philosophers (like Eric Olson and others) who favor animalism must be attracted to. The attraction of animalism is this: individuation requires limits or boundaries and, for animalism, whatever is in the animal as a proper part of its being alive therein is in the person, whereas whatever is outside of the animal therein is outside of the person. So, if I am a particular living human animal, and if something is in or out of me, this means it is inside or [End Page 323] outside, respectively, my living body. Various neurons are in me; the heavenly stars are out of me. Various information processes are in me; the athletic dispositions of the Boston Red Sox are out of me.Suppose animalism is true. Beginning from an earlier claim of mine that there was really no such area of study as the philosophy of sport, Part One of the paper reconsiders the place previously given to David Best’s distinction between purposive sports and aesthetic sports. In light of a famous cricketing event in the 1977 contest between England and Australia (‘The Ashes’), in which Derek Randall turned a cartwheel after taking the winning catch, the paper clarifies that not all aesthetically-pleasing events taking place in (...) sporting competitions can be understood as the aesthetic in sport. Then, in Part Two, the force of the claim that philosophy is one subject is explored. The conclusion is that a focus just on the philosophy of sport is necessarily inappropriate, since it will present the student with only cases from sport to then apply to sport. Rather, one’s understanding must be informed by (much of) the breadth of philosophy. Charles Travis’s view of occasion-sensitivity provides a clear example of appropriately contextual appeal. Part Three of the paper returns to the need for an institutional account of sport, one recognizing that there is no one occasion on which a particular sport is played; and hence no single set of conditions which can uniquely identify that sport. Thus, soccer played with one’s children typically differs from elite soccer: but both are (genuinely) soccer. When one turns to the appreciation of sport (in the light of Stephen Mumford’s excellent Watching Sport: Aesthetics, Ethics and Emotion [2012a]), one recognizes that, in order to genuinely appreciate sport, one cannot detach oneself from the outcome as completely as Mumford’s extreme purist seems to. But reflection on that case may also return us to contextualism by moving us away from attachments to the complete or the exceptionless in our accounts of spectating as of sport: maybe there is no one thing that occurs in all the relevant cases. Philosophy written in English is overwhelmingly analytic philosophy, and the techniques and predilections of analytic philosophy are not only unhistorical but anti-historical, and hostile to textual commentary. Contemporary ethical thought owes a great deal to David Hume whose work has inspired theories as diverse as non-cognitivism, error theory, quasi-realism, and instrumentalism about practical reason. This timely volume brings together an international range of distinguished scholars to discuss and dispute issues revolving around three closely related Humean themes which have recently come under close scrutiny. First is Hume's infamous claim that 'Reason is, and ought only to be, the slave of the passions'.
